Terms of service

GENERAL PROVISIONS

 

  1. The following Terms of Service apply to all orders placed at cuddlesheets.com.
  2. These Terms of Service govern the legal relationship between the Seller and the Buyer for the sale of goods.
  3. The Terms of Service are a binding legal document for both parties and establish the conditions for ordering goods, payment, delivery, returns, responsibilities, and other terms related to the purchase of goods through cuddlesheets.com.
  4. Cuddle Sheets is a consumer-facing business. Orders from businesses or for resale are not accepted unless agreed in writing. Products may not be resold, modified, or used in the production of other goods without express written permission from the Seller.
  5. Definitions: 5.1. Seller – MB "Darsyk", legal entity code 307156503, registered office at P. Vileišio g. 28-45, LT-10203 Vilnius, Lithuania, email: admin@cuddlesheets.com; 5.2. Buyer – the person who places an order for a product via the Website; 5.3. Contract – the sale agreement formed between the Buyer and Seller upon order placement; 5.4. Parties – the Buyer and Seller jointly; 5.5. Order – an online purchase process initiated by the Buyer through the Website; 5.6. Consumer – a natural person purchasing goods not related to their trade, business, or profession; 5.7. Entrepreneur – a legal or natural person acting in a commercial or professional capacity.

CONTRACT FORMATION

 

  1. Product images on cuddlesheets.com are for illustrative purposes. Products are dispatched based on selected variants.
  2. By listing products, we invite the customer to place an order. Adding a product to the cart is non-binding. A binding contract is formed when the Buyer completes checkout and successfully pays for the order.
  3. Buyers may modify their cart at any time before confirming payment. If an order is not completed, we may send a reminder email.
  4. Order confirmation is provided via email immediately after purchase.

CONTRACT TERMS, LANGUAGE, AND RETENTION

 

  1. By placing an order, the Buyer agrees to these Terms of Service and our Privacy Policy.
  2. Buyers are required to provide necessary personal data to complete orders, in accordance with our Privacy Policy.
  3. The sale contract is governed by the law of the Republic of Lithuania. In unresolved cases, disputes shall be settled by Lithuanian courts unless local consumer protection law requires otherwise.
  4. Product information, care, and usage instructions may be provided with the order or by email.
  5. The version of the Terms of Service in effect at the time of the Buyer’s order will govern the contract.

DELIVERY TERMS 

  1. Delivery is fulfilled through third-party couriers. In-person pickup is not available.
  2. Risk of accidental damage or loss transfers to the Buyer at the moment of delivery.
  3. If delivery fails due to customer unavailability, we will attempt to reschedule. Uncollected goods will be returned to the Seller and refunded minus delivery and processing costs.

INTERNATIONAL ORDERS

  1. Cuddle Sheets sells globally. Orders placed from outside the EU may be subject to import duties, taxes, or customs fees not included in the final checkout price.
  2. Delivery timelines and tracking may vary depending on the destination country. Buyers outside the EU accept responsibility for complying with local import laws.
  3. Return shipping from outside the EU is at the customer’s expense unless the product is defective or incorrect.

PAYMENT

Accepted payment methods:

  3. Shopify Payments
  4. Apple Pay
  5. All transactions are securely processed by third-party providers. Payment terms may be governed by those providers' terms and policies.

DAMAGE DURING DELIVERY

  1. The Buyer must inspect deliveries upon receipt. Any visible damage must be noted with the courier and reported immediately to the Seller.
  2. Claims for visible damage submitted after delivery without prior inspection may be denied.

PRODUCT QUALITY 

  1. The Seller does not provide a commercial warranty beyond legal consumer protection rights.
  2. In the event of defects or damaged items, the Buyer has the right to:
  • Request repair or replacement;
  • Receive a partial refund;
  • Cancel the contract.

RETURNS

Buyers may return unused, undamaged products within 30 days of delivery.

  1. Return shipping costs are the Buyer's responsibility unless the return is due to Seller error or product defect.
  2. Products must be in original packaging and condition. Refunds may be reduced or denied if:
  • The item was used, washed, or damaged;
  • The packaging is missing;
  • Hygiene standards are compromised.

RESPONSIBILITY 

  1. All legal relationships are governed by the law of the Republic of Lithuania. However, international customers may rely on local mandatory consumer protections where applicable.
  2. The Seller’s liability is limited to the extent permitted by applicable consumer law. The Seller shall not be liable for any indirect, incidental, punitive, or consequential damages, including but not limited to loss of profits, emotional distress, or personal injury claims not directly caused by the use of the product as intended. The Seller’s maximum liability shall be limited to the value of the product purchased.

FORCE MAJEURE

The Seller is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, war, terrorism, labor strikes, governmental actions, or disruptions in transportation or supply chains.

DISPUTE RESOLUTION

  1. Customers should direct any complaints to admin@cuddlesheets.com
  2. We aim to respond within 14 calendar days.
  3. If a resolution cannot be reached, EU-based customers may contact:
